Recommendation to company I. to take measures to prevent the publication of advertisements containing discriminatory terms

Acting within the framework of legally prescribed competencies to monitor the implementation of laws concerning the prohibition of discrimination and to recommend measures to achieve equality to the public authorities and other persons (Art. 33, items 7 and 9 of the Law on the Prohibition of Discrimination, “Official Gazette of RS”, No. 22/2009), the Commissioner for the Protection of Equality addresses to the “I” d. o. o. from S. (also sent to the addresses of 11 advertiser who posted this advertisement on internet job exchanges) the following


  1. “I” d. o. o. from S. in the future will not publish job advertisements containing discriminatory conditions of employment, such as those relating to gender, age, and appearance of a candidate, or any other personal property. An exception are situations where a job advertisement relates to a job with such nature, or when the work is carried out under such conditions, that a personal property constitutes a real and decisive condition for the performance of the job, if the intended purpose is justified, in accordance with Art. 16 para. 3 of the Law on the Prohibition of Discrimination and Art. 22 of the Labor Law.
  2. “I.” d. o. o. from S. will, without delay, take all necessary measures to prevent any possibility of publication of job advertisements which, contrary to the law, contain discriminatory conditions for employment, and will inform the Commissioner for the Protection of Equality on the measures taken no later than 30 days from the date of receipt of this recommendation.
