OPINION
The opinion was adopted in the proceedings regarding the complaint of organization A. A., filed against company B. B., Sombor Branch Office, because the facility of this company at street 32 in Sombor is not accessible to people with disabilities. During the procedure, a statement was requested from Company B. B. In the statement, it was specified that in the current practice of the employees in the branch office in Sombor, persons with disabilities realize their needs by the person who is accompanying the disabled person entering the branch office, and the agents prepare contracts/equipment and present them to the user in front of the entrance to the office, and that in order to enable unhindered access to this facility for persons with disabilities, contact has been established with companies that trade in flexible (mobile) ramps, as well as that in the current year, the relocation of the office to a new location is planned, which will definitely be adapted for access persons with disabilities. During the procedure, it was established that the facility where the Sombor Branch Office is located is not accessible to people with disabilities, which is why the Commissioner issued the opinion that by not ensuring the accessibility of the facility in Sombor where the Branch Office of Company B.B. is located, there was a violation of the provisions of Arts. 6, 17 and 26 of the Law on Prohibition of Discrimination, in connection with the provisions of Arts. 13 and 16 of the Law on Prevention of Discrimination of Persons with Disabilities. The Commissioner for the Protection of Equality recommended the company B. B. to undertake activities aimed at ensuring the accessibility of the building where the Sombor Branch Office is located, as well as to take care not to violate regulations on the prohibition of discrimination in the future.
