Recommendation on measures to achieve equality to the National Employment Service

Acting within the framework of legally prescribed competencies [1] to monitor the implementation of laws concerning the prohibition of discrimination and to recommend measures to achieve equality to the public authorities and other persons (Article 33, items 7 and 9 of the Law on the Prohibition of Discrimination, “Official Gazette of RS”, number 22/09), the Commissioner for the Protection of Equality addresses to the National Employment Service the following

 

 

RECOMMENDATION ON MEASURES TO ACHIEVE EQUALITY

  1. The National Employment Service will take all necessary measures within its jurisdiction in order to provide an effective system for controlling advertisements submitted by the employers to the National Service, as well as advertisements that the employers themselves place on the site of the National Service, in order to prevent the publication of job advertisements containing discriminatory conditions for employment, except when the job advertisement relates to a job whose nature is such, or the work is carried out under such conditions that a personal characteristic represents a real and decisive condition for the performance of that job, if the purpose to be achieved is justified, in accordance with Article 3, Law on the Prohibition of Discrimination and Article 22 of the Labor Law.
  2. The National Employment Service will take care of the use of gender-sensitive occupation titles, or the use of one gender with the application of the general rule that all terms used in one grammatical gender will include the male and female gender of persons to whom they relate.
  3. The National Employment Service will inform the Commissioner for the Protection of Equality on the measures taken in order to act upon this Recommendation, no later than 30 days from the date of receipt of this Recommendation.
