Acting within the statutory competence[1] to monitor the implementation of the laws on the prohibition of discrimination and recommend measures for achieving equality to the public authorities and other persons, the Commissioner for the Protection of Equality refers to the Ministry of Education, Science and Technological Development the following

RECOMMENDATION OF MEASURES FOR ACHIEVING EQUALITY AND PROTECTION AGAINST DISCRIMINATION

The Commissioner for the Protection of Equality recommends that the Ministry of Education, Science and Technological Development:

• amend the provisions of Article 6, paragraph 3 of the Rulebook on enrollment in secondary schools (“Official Gazette of RS”, No. 31/2021 and 46/2021) and harmonize it with the Law on Ratification of the Convention on the Rights of Persons with Disabilities, the Law on Fundamentals of the Education and Upbringing System, the Law on Secondary Education and Upbringing and the Law on Prohibition of Discrimination,

• allow, in cooperation with the School for Primary and Secondary Music Education “Stevan Mokranjac” in Požarevac, candidates with disabilities, who have completed primary school according to IOP2 and took the entrance exams for enrollment in this music school in May 2021, and who needed an adjustment of the content, to retake the entrance exam, in accordance with the needs for providing support related to the content and manner of conducting the entrance exam.

The Ministry of Education, Science and Technological Development will inform the Commissioner for the Protection of Equality about the measures taken in order to implement this recommendation, within 30 days from the day of receipt of the recommendation of measures for achieving equality.

In accordance with the law, no appeal or any other legal remedy is allowed against this recommendation of measures for achieving equality.
