OPINION

The opinion was issued in the proceedings regarding the complaint of D.S.I., filed against “P b 1” in F. In the complaint, the applicant stated, among other things, that the bakery window was plastered with an image of an insert from a film, with accompanying text, which is derisive and sneering, and insults women. In his statement on the complaint, the bakery owner stated that his intention was “of a humorous nature”, namely, that it was not aimed at discriminating against women, as well as that the picture on the shop “does not represent anything except attracting customers and making citizens laugh”. During the procedure, it was established that the advertisement for which the complaint was filed was on the door of the facility, that in the foreground is a woman rolling out dough with a rolling pin, and that behind her is a man moving his hands towards the area of ​​her breasts, and that on the woman’s body the following text is written: “knead, knead, it won’t harm you”. Taking into account the place where the photo was placed, i.e., the fact that it represents an advertisement for a facility where public services will be provided, as well as the position of the woman and man and their body language, the Commissioner for the Protection of Equality issued the opinion that the advertisement for the bakery “P b 1” in F, street …, violated the provisions of Article 12 in connection with Article 20 of the Law on Prohibition of Discrimination. R. S., the owner of the bakery “P b 1” in F, was recommended to remove the disputed advertisement from the facility of the bakery “P b 1” in F, on the street …, as well as to take care in the future not to violate legal regulations on the prohibition of discrimination.
