OPINION
The opinion was issued in a procedure following a complaint filed by M.Š. from N, against the National Employment Service (NES), Branch Office in N. The complainant stated that during employment mediation according to the applications submitted by “Y. C.” enterprise, NES had referred only male candidates not older than 35 years of age to job interviews and that she had suffered discrimination on the grounds of gender and age. In the statement of NES, branch N. it was stated that the selection and referral of the candidates had been performed exclusively according to the criteria defined by the employer, which relate to competencies and working conditions. During the procedure, it was established that NES had provided evidence confirming that “Y. C.” equally referred candidates of both genders, as well as candidates older than 35 years to job interviews during 2014. The Commissioner for the Protection of Equality issued an opinion stating that M. Š. did not suffer discrimination from National Employment Service, Branch N. on the grounds of gender and age during employment mediation.
