OPINION

The opinion was issued in the procedure following complaint from Lj.A. against the City Municipality of Lazarevac. The complaint states that her son is a person with disabilities and that she uses a wheelchair, and that Lazarevac does not provide transportation accessible to people with disabilities. The declaration of the Municipality of Lazarevac states that Lazarevac does not provide transportation accessible to persons with disabilities, and that the organization of public transport in the territories of the city municipalities is under the jurisdiction of the City of Belgrade, the Secretariat for Transport, Directorate for Public Transport. The declaration of the Directorate for Public Transport states that local and suburban public regular passenger transport is organized in the territory of the City Municipality of Lazarevac under the jurisdiction of the Secretariat for Transport, and that in the future, they will try to, in a number of local lines, consider the possibility of introducing low-floor vehicles with mechanical ramps for the access of persons with disabilities. During the procedure, it was established that the organization of public transport in the territory of the City Municipality of Lazarevac is under the jurisdiction of the Secretariat for Transport, Directorate for Public Transport, and that public transport in the territory of the City Municipality of Lazarevac is not accessible to persons with disabilities. The Commissioner for the Protection of Equality expressed the opinion that the non-organization of public transport accessible to persons with disabilities in the territory of the City Municipality of Lazarevac, the City Administration of the city of Lazarevac, against which the complaint was filed, did not violate the Law on the Prohibition of Discrimination. Bearing in mind that the organization of public transport in the territory of the city of Lazarevac is under the jurisdiction of the City Administration of the City of Belgrade, the Secretariat for Transport, Directorate for Public Transport, the Commissioner for the Protection of Equality submitted the appropriate recommendation of the measures to the City Administration of the City of Belgrade, the Secretariat for Transport, Directorate for Public Transport.
