Recommendation for measures to achieve equality for the Ministry of Defense in the area of labor and employment

Acting within the framework of legally prescribed competencies to monitor the implementation of laws concerning the prohibition of discrimination and to recommend measures to achieve equality to the public authorities and other persons (Art. 33, para. 1, items 7 and 9 of the Law on the Prohibition of Discrimination, “Official Gazette of RS “, No. 22/2009), the Commissioner for the Protection of Equality addresses to the Ministry of Defense of the Republic of Serbia the following

 

RECOMMENDATION ON MEASURES TO ACHIEVE EQUALITY

 

  1. It is necessary for the Ministry of Defense of the Republic of Serbia to harmonize the Decision on special criteria for admission to work in the Defense Delegation of the Republic of Serbia (“Official Gazette of the Republic of Serbia” No. 25/ 09, 15/11 and 24/13, Art. 41, para. 5) with anti-discrimination regulations by removing specific criteria related to the marital status of candidates.
  2. In future it is necessary for the Ministry of Defense of the Republic of Serbia to ensure that in its decisions, as well as when publishing internal and public vacancies, it does not violate the provisions of the Law on Prohibition of Discrimination and other anti-discrimination regulations.
  3. The Ministry of Defense of the Republic of Serbia will inform the Commissioner for the Protection of Equality on the measures planned in order to implement this Recommendation, within 30 days from the date of receipt of the Recommendation on measures to achieve equality.

No appeal or any other legal remedy is allowed against this Recommendation on measures to achieve equality, since the Recommendation does not decide on the rights and obligations of legal entities.
