OPINION

 

The opinion was issued in a procedure following a complaint filed by J. P. from B. against PE “Srbijagas” Novi Sad. The complainant stated that she was 62 years of age with 34 years and 9 months of length of service, and that by signing Annex III of the Employment Contract no. 01-01-1/478 of December 9, 2014, she had been transferred from a job of a technical secretary of the Development Sector B, with a coefficient of 3.46 to the Distribution Sector P, to the administrative affairs 5, with a coefficient of 3.02, and that the place she had been working in was changed from B. to P. In the declaration of PE “Srbijagas” Novi Sad, it was stated that the complainant had been transferred to another post because of the need for reorganization and rationalization of the company’s operations, and in accordance with the instructions of the Government of the Republic of Serbia. During the procedure it was established that there were also employed persons of 29 to 65 years of age among the employees who had been transferred to other posts and who had changed their workplace. It was established that PE “Srbijagas” Novi Sad provided sufficient evidence to conclude that the offer from the Annex to the employment contract by which J. P. had been moved to another post and by which her coefficient had been reduced, had not been influenced by her age. The Commissioner for the Protection of Equality issued an opinion stating that Annex no. III of the Employment Contract number 01-01-1/478 of December 9, 2014, by which J. P. had been assigned to another post, to another workplace, and by which a lower job coefficient had been determined, i.e. PE “Srbijagas” Novi Sad did not violate the provisions of the Law on the Prohibition of Discrimination.
