The opinion was issued in the procedure following a complaint filed by О. S. from B. against PE “Srbijagas”Novi Sad. The complainant stated that she was 62 years old and had 35 years and eight months of service and that, by signing Annex II to the employment contract No. 01-01-1/482 dated 9 December 2014, she was transferred from the post of manager IV in the Gas Distribution Sector with 3.46 coefficient to the post of clerk 5 in the Transport Sector Novi Sad with 3.02 coefficient, and that her place of work was changed from B. to P. PE “Srbijagas” Novi Sad stated in a declaration that the complainant was transferred to another post due to a need for the re-organization and rationalization of the enterprise’s business, in accordance with the instruction of the Government of the Republic of Serbia. In the course of the procedure was determined that the employees who were transferred to other posts, and whose place of work was changed and coefficient reduced, included people aged from 29 to 65. It was determined that PE “Srbijagas” Novi Sad provided sufficient evidence to conclude that the annex to the employment contract, by which О.S. was transferred to another place of work with reduced coefficient, was not offered due to her age. The Commissioner for the Protection of Equality issued an opinion that PE “Srbijagas” Novi Sad did not violate the provisions of the Law on the Prohibition of Discrimination with Annex No. II to the employment contract No. 01-01-1/482 dated 9 December 2014, by which O. S. was assigned to another post and another place of work with reduced coefficient.
