Recommendation to the Ministry of Health

Acting within the framework of legally prescribed competencies to monitor the implementation of laws concerning the prohibition of discrimination and to recommend measures to achieve equality to the public authorities and other persons (Article 33, items 7 and 9 of the Law on the Prohibition of Discrimination, “Official Gazette of the Republic of Serbia”, No. 22/2009), the Commissioner for the Protection of Equality addresses to the Ministry of Health of the Republic of Serbia the following

 

RECOMMENDATION ON MEASURES TO ACHIEVE EQUALITY

 

It is necessary that the Ministry of Health of the Republic of Serbia issues a mandatory instruction to all health care institutions in Serbia, or otherwise inform them that:

  1. The data on the HIV status of the patients are not to be recorded outside the heading provided in the medical documentation for entering such data.
  2. If the HIV status is relevant for medical treatment, the data should be entered in the section of the medical documentation provided for entering of diagnoses (or other diagnoses), using the same size and color of letters that are normally used for entering diagnoses and statuses of significance for medical procedure, and using the Latin name and code of the disease according to the International Classification of Diseases, Injuries and Causes of Death.

The Ministry of Health of the Republic of Serbia will inform the Commissioner for the Protection of Equality of the measures planned in order to implement this Recommendation, within 30 days from the date of receipt of the Recommendation for measures to achieve equality.

No appeal or any other legal remedy is allowed against this Recommendation on measures to achieve equality, since the Recommendation does not decide on the rights and obligations of legal entities.
