Recommendation on measures to achieve equality of persons with disabilities in procedures involving public notary services

Acting within the framework of legally prescribed competencies [1] to monitor the implementation of laws concerning the prohibition of discrimination and to recommend measures to achieve equality to the public authorities and other persons, the Commissioner for the Protection of Equality addresses to the Ministry of Justice and the Chamber of Public Notaries of Serbia the following

RECOMMENDATION ON MEASURES TO ACHIEVE EQUALITY

  1. It is necessary that the Ministry of Justice and the Chamber of Public Notaries of Serbia take all measures and activities within their jurisdiction in order to harmonize the Public Notary Tariff [2] with anti-discrimination regulations, so that persons with disabilities who, in order to secure the validity of actions taken, provide the presence of witnesses or interpreters when compiling documents in a non-litigation procedure, or in a procedure of verification of signatures, manuscripts and transcripts, are released from the obligation of paying an increased tariff due to the participation of witnesses or interpreters.

 

  1. The Ministry of Justice and the Chamber of Public Notaries of Serbia will inform the Commissioner for the Protection of Equality about the measures taken to implement this recommendation within 30 days from the date of receipt of the Recommendation on measures to achieve equality.
