Acting within the competences prescribed by law[1] to monitor the implementation of laws concerning the prohibition of discrimination and send recommendations of measures to public authorities and other persons for the realization of equality and protection against discrimination, the Commissioner for the Protection of Equality sends to the elementary school the following
RECOMMENDATION OF MEASURES FOR ACHIEVING EQUALITY AND PROTECTION AGAINST DISCRIMINATION
In order to achieve equality and protection against discrimination, to ensure equal opportunities for advancement to all children and students and the best interest of children in educational institutions, the Commissioner recommends the school to:
- Initialize, in accordance with the Rulebook on the institution’s actions in case of suspected or established discriminatory behavior and insult to the reputation, honor or dignity of a person (“Official Gazette of the RS,” No. 65/2018), the preparation of a detailed and comprehensive desegregation plan and undertake intervention measures and activities from the Rulebook.
- Inform the competent school administration, the Ministry of Education, and the local self-government unit in writing about the existence of segregation, that is, about the risk of segregation, and in accordance with the Rulebook on the institution’s actions in case of suspected or established discriminatory behavior and insult to the reputation, honor or dignity of a person, request in written form their involvement in the desegregation process.
It is necessary that the school informs the Commissioner about the action taken within 30 days of receiving the recommendation of measures for achieving equality.
Against this recommendation of measures to achieve equality, in accordance with the law, no appeal or any other legal remedy is allowed.
