Acting within the jurisdiction prescribed by law[1] to monitor the implementation of laws concerning the prohibition of discrimination and submit recommendations for measures to public authorities and other persons for the realization of equality and protection against discrimination, the Commissioner for the Protection of Equality submits to the Ministry the following

 

RECOMMENDATION OF MEASURES FOR ACHIEVING EQUALITY AND PROTECTION AGAINST DISCRIMINATION

 

The Commissioner for the Protection of Equality recommends the Ministry to:

– consider as consecutive assessments, when deciding on the advancement of female civil servants employed in the ministry, the assessments obtained for the years in which the civil servant was evaluated, leaving out the year in which she was not assessed due to the use of pregnancy or maternity leave, or leave from work for child care, that is, not to discontinue the sequence of assessments of those eligible for promotion because the civil servant was not assessed due to the use of pregnancy or maternity leave or leave from work for child care.

– inform the organizational unit/sector dealing with human resources about this recommendation.

The administration must inform the Commissioner about the aforementioned action following this recommendation within 30 days of receiving the recommendation of measures for achieving equality.

Against this recommendation of measures to achieve equality, according to the law, no appeal or any other legal remedy is allowed.
