Acting within the legally prescribed competence[1] to monitor the implementation of laws concerning the prohibition of discrimination and recommend to public authorities and other persons measures for achieving equality and protection against discrimination, the Commissioner for the Protection of Equality refers

RECOMMENDATION OF MEASURES FOR ACHIEVING EQUALITY

The Commissioner for the Protection of Equality recommends that the Ministry of Family Welfare and Demography and the Ministry of Labor, Employment, Veterans’ and Social Affairs to:

– specify the Instruction on the conduct of municipal – city administrations and centers for social work in the application and implementation of decisions of the Constitutional Court of the Republic of Serbia no. IUz-216/2018, IUz-247/2018 and IUz-266/2017 of 2 August 2021, in the part related to the submission of requests for amendment of an individual act (decision) which is final in accordance with the provision of Article 61 of the Law on the Constitutional Court.

The Ministry of Family Welfare and Demography and the Ministry of Labor, Employment, Veterans’ and Social Affairs will notify the Commissioner for Protection of Equality of the measures taken to implement this recommendation, within 30 days of receiving the recommendation of measures to achieve equality.

No appeal or any other legal remedy is allowed against this recommendation of measures for achieving equality, because it does not decide on the rights and obligations of legal entities.
