OPINION
The opinion was issued in a procedure following a complaint filed by J.V.N. from Z. against PE “Srbijagas” Novi Sad. The complainant stated that she was 62 years of age with 34 months of length of service and that by signing Annex III of the Employment Contract no 00-01-28/1-400/3 of December 5, 2014 she had been transferred from a “computer data processing operator” post, with the salary coefficient of 3.46, to a “purchasing officer” post, with a salary coefficient of 3.02. In the declaration of PE “Srbijagas” Novi Sad, it was stated that the complainant had been transferred to another post because of the need for reorganization and rationalization of the company’s operations, and in accordance with the instructions of the Government of the Republic of Serbia. During the procedure it was established that there were also employed persons of 29 to 65 years of age among the employees who had been transferred to other posts and whose job coefficient had been reduced. It was established that PE “Srbijagas” Novi Sad provided sufficient evidence to conclude that the offer from the Annex to the Employment Contract by which J.V.N. had been moved to another post and by which her salary coefficient had been reduced, was not influenced by her age. The Commissioner for the Protection of Equality issued an opinion stating that Annex no. III of the Employment Contract No. 00-01-28/1-400/3 of December 5, 2014, by which J. В. N. had been assigned to another post and by which a lower salary coefficient had been calculated, i.e. PE “Srbijagas” Novi Sad did not violate the provisions of the Law on the Prohibition of Discrimination.
