OPINION

 

The opinion was issued in a procedure following a complaint filed by J. Ć. from N. S. against the Health Center in N. S. The complaint stated that J. Ć. tried to obtain a medical certificate for retraining or enrolment in a secondary medical school, a nurse-technician course. The complainant stated that the certificate had not been issued. Director of the Health Center N. S. (in his/her declaration) stated that assessment of health status for enrollment in a secondary medical school for J. Ć. could not be issued because J. Ć. did not attend the prescribed examinations and did not submit the necessary medical documentation. During the procedure, it was established that the Health Center N. S. did not offer evidence in terms of justified and objective reasons why J. Ć. had not been issued a medical certificate on the assessment of health status for enrolment in a secondary medical school, a nurse-technician course, i.e., for the purpose of retraining, which is not related to his health status. The Commissioner for the Protection of Equality issued an opinion stating that the Health Center N. S, by failing to issue a medical certificate on the assessment of health status of J. Ć, violated the provisions of the Law on the Prohibition of Discrimination and recommended to the Health Center N. S. and Director M. K, as a responsible person, to take all necessary measures to eliminate the consequences of discriminatory treatment of J. Ć. In the future, they are not to violate anti-discriminatory regulations within the framework of performing tasks within their competence.
