Acting within the framework of legally prescribed competencies[1] to monitor the implementation of the laws concerning the prohibition of discrimination and recommend measures for the achievement of equality to public authority bodies and other persons, the Commissioner for the Protection of Equality hereby issues to the Ministry of Labour, Employment, Veteran and Social Policy the following

 

RECOMMENDATION ON MEASURES FOR ACHIEVING OF EQUALITY

 

The Commissioner for the Protection of Equality recommends to Ministry of Labour, Employment, Veteran and Social Affairs:

  • To withdraw their letter no. 560-00-334/2018-01 from May 2018 and to point out to the Centers for Social Work the obligations arising under the Constitution, ratified international instruments and laws concerning the necessity of taking all measures within their jurisdiction in order to support the families which are at risk of children being displaced from the family, and that alternative child care is organized by Centers for Social Work only when all previous efforts to prevent family separation have failed or when separation is evidently in the best interest of the child’s health, well-being, development and/or safety.
  • To undertake other measures within its jurisdiction to strengthen social protection services and to create new services that are necessary to enable the child’s life within family environment.

The Ministry of Labour, Employment, Veteran and Social Affairs will inform the Commissioner for the Protection of Equality of the planned measures in order to implement this recommendation, within 30 days from the date of receipt of the recommendation on the measures for the achievement of equality.

No appeal or any other legal remedy is allowed against this recommendation on measures for the achievement of equality, since the recommendation does not decide on the rights and obligations of legal entities.
