Complaint filed by L.T. against the Ministry of Internal Affairs, City of B. Police Department on account of discrimination on the grounds of gender

OPINION

The present opinion was issued following a complaint procedure lodged by L.T. against the Ministry of Internal Affairs, City of B. Police Department on account of discrimination on the grounds of gender. In her complaint the complainant claimed that since 2009 she has been working as a Police Station for Railroad Safety Deputy Commander, with the City of B. PA Police Department and that on 27 June 2016 she was reassigned to a lower ranking job position – job position: officer – miscellaneous police affairs with the Prevention and Community Policing Unit within the Police Administration – with a lower salary coefficient when compared to the previous job position, but has retained her previous job title: independent police inspector, and that a male colleague has been assigned to the Deputy Commander job position. In its declaration, City of B. Police Department stated that the Police Administration was of the opinion that assigning L.T. to the job position: officer – miscellaneous police affairs with the Prevention and Community Policing Unit within the Police Administration, would strengthen L.T.’s work ethics and enhance her on-the-job performance, while M.G. was assigned to the Police Station for Railroad Safety Deputy Commander job position as he was highly committed, a motivated self-starter, efficient and result-oriented professional, qualities he had demonstrated in his everyday work. In the course of the complaint procedure, the Commissioner for the Protection of Equality has ascertained that the facts and evidence offered by the City of B. Police Department gave no solid grounds which would lead to a conclusion that assigning L.T. was in fact based on objective and justified reasons unrelated to her gender. Hence, the Commissioner for the Protection of Equality issued an opinion stating that by reassigning L.T. to a lower ranking job position, the City of B. Police Department of the Ministry of Internal Affairs has committed an act of discrimination on the grounds of L.T.’s personal characteristic – gender. For this reason the Commissioner for the Protection of Equality issued a recommendation to the City of B. Police Department of the Ministry of Internal Affairs to take measures within their scope of authority aimed at eliminating consequences of such discriminatory treatment of L.T. and to refrain from violating anti-discrimination legislation in the course of their regular work and activities in the future.
