Recommendation of measures to the City Municipality of Zemun for the forced eviction of the inhabitants of the Roma settlement

Acting within the framework of legally prescribed competencies to monitor the implementation of laws concerning the prohibition of discrimination and to recommend measures to achieve equality to the public authorities and other persons (Article 33, items 7 and 9 of the Law on the Prohibition of Discrimination, “Official Gazette of the Republic of Serbia”, No. 22/2009), the Commissioner for the Protection of Equality addresses to the City Municipality of Zemun the following

RECOMMENDATION ON MEASURES TO ACHIEVE EQUALITY

 

  1. The City Municipality of Zemun will refrain from forced eviction of the inhabitants of the Roma settlement Grmeč in Zemun until it has previously provided alternative accommodation, equal or higher in terms of quality than the living conditions in that settlement, which must conform to the criteria of adequate housing in accordance with international standards.
  2. The City Municipality of Zemun will implement the entire process of providing for and integration of the inhabitants of the Roma settlement Grmeč in Zemun, in cooperation and with active participation of those persons, respecting their needs and their right to participate in decision-making in relation to all issues that concern them, including relocation and the way of social integration, in accordance with international standards and guidelines for displacement of citizens from informal settlements.
  3. The City Municipality of Zemun will inform the Commissioner for the Protection of Equality of measures taken, not later than 30 days from the date of receipt of this Recommendation.

No appeal or any other legal remedy is allowed against this Recommendation on measures to achieve equality, since the Recommendation does not decide on the rights and obligations of legal entities.
