OPINION

 

The opinion was issued in the procedure following complaint from R.I.C. against the company N. d.o.o. B. which was the publisher of the Internet portal S.I. The complaint was filed on account of several articles published by the portal from May 2015 to March 2016, which discriminated against LGBT population. During the procedure, it was established that in the course of reporting about the LGBT population, in the articles: “Good job – gay parade broken up in Moldova”, “Sodom and Gomorrah in Belgrade”, “The Parade of Shame ended”, “Terrible: They promoted pedophilia on the gay parade in Belgrade”, “Homosexuals create a gay population”, “Homosexuality, illness or orientation” and “Satanisation of Serbia and its political establishment” published on this portal in the period from May 2015 to March 2016, dignity of persons of different sexual orientation was hurt by the editorial office of the portal S.I. and created fear, hostile, humiliating and insulting environment against the LGBT population. People of homosexual orientation in those articles were brought into the context of illness, depravity, pedophilia. It was found that the method of reporting by portal S.I. about the LGBT population in the above articles was unacceptable and contrary to anti-discrimination regulations. Therefore, opinion was given that the titles of the articles: “Good job – gay parade broken up in Moldova” and “Sodom and Gomorrah in Belgrade” as well as “The Parade of Shame ended”, “Terrible: They promoted pedophilia on the gay parade in Belgrade”, “Homosexuals create a gay population”, “Homosexuality, illness or orientation” and “Satanisation of Serbia and its political establishment” published on the portal S.I. in the period from May 2015 to March 2016 expressed ideas and attitudes that were disturbing and humiliating and insulting for dignity of persons of a different sexual orientation from heterosexuals. Portal S.I. was recommended to send an apology to male and female members of the LGBT population for expressing discriminatory attitudes by publishing it on that portal, and not to publish the articles offending dignity of male and female members of the LBT population in the future and not to support stereotypes towards people of the same-sex orientation, and to contribute to reduction of homophobia, violence and discrimination, and increase of tolerance towards that population, as well as to all other minority groups.
