RECOMMENDATION OF MEASURES TO ACHIEVE EQUALITY NO. 522/2012
The Recommendation has been made within the legally prescribed competence of the Commissioner for the Protection of Equality to monitor the implementation of the laws concerning the prohibition of discrimination and recommend to the public authorities and other persons measures to achieve equality, in the proceedings conducted upon the information that medical commissions which issue medical certificates of physical and mental fitness to drive a motor vehicle don’t have uniform practices and procedures when issuing medical certificates to people with disabilities.
RECOMMENDATION
The Commissioner for Protection refers to the Ministry of Health the recommendation of measures to achieve equality:
- The Ministry of Health shall take all necessary measures within its competence in order to ensure that the medical commissions: 1) harmonize their practice in issuing medical certificates of physical and mental fitness to drive a motor vehicle for persons with disabilities; 2) when issuing medical certificates, take into account the development of assistive technologies, in particular those related to the possibilities of adaptation of vehicles for persons with disabilities (e.g., if possible in each specific case, 3) in addition to examining a person with disabilities and the insight into their medical documentation, also inspect the adapted vehicle, in order to ensure that the technical characteristics of the adapted vehicle allow the person with disabilities to participate safely in traffic); 4) when issuing medical certificates, be guided by the principle of full social inclusion of persons with disabilities.
- It is necessary for the Ministry of Health to inform the Commissioner for the Protection of Equality of the planned measures in order to implement this recommendation, within 30 days from the date of receipt of the recommendation on measures to achieve equality.
