The Commissioner for the Protection of Equality informs the public that the public enterprise “Pošta Srbije” has failed to comply with the recommendations of the Commissioner’s institution issued following the established discrimination against two employees on the grounds of their political beliefs and trade union activity, as personal characteristics.
Namely, acting upon the complaints of the two employees, the Commissioner issued an opinion that the public enterprise “Pošta Srbije” had violated the provisions of the Law on the Prohibition of Discrimination. In the proceedings, it was established that the complainants had been placed in a less favorable position by being offered an annex to their employment contracts transferring them to a distant place of work, and one of them also to a lower position, immediately after their participation in a workers’ protest and their support for trade union demands. During the proceedings, the public enterprise “Pošta Srbije” failed to prove that the reasons for such conduct were unrelated to the personal characteristics of the employees, that is, it failed to prove that there were justified and objective reasons for such treatment.
Bearing in mind that the public enterprise “Pošta Srbije,” even after being issued a warning, did not comply within the statutory period of 30 days with the recommendation to remove the consequences of the discriminatory conduct, send a written apology to the complainants, and in the future take care not to violate the legal provisions prohibiting discrimination, the Commissioner for the Protection of Equality, Milan Antonijević, in accordance with the law, informs the public of the failure to comply with the issued recommendation.
