    OPINION<\/strong><\/p>\n

    The opinion was issued in the procedure following a complaint filed by M. N. from B. against PE \u201cSrbijagas\u201d Novi Sad. The complainant stated that she was 60 years old and had 37 years of service and that, by signing Annex III to the employment contract No. 01-01-1\/475 dated 9 December 2014, she was transferred from the post of a clerk in the Representation Division in B. with 3.15 coefficient to a new post of an operator in the \u0422\u0422 central station in the Transport Sector in P. with 2.02 coefficient. PE \u201cSrbijagas\u201d Novi Sad stated in a declaration that the complainant was transferred to another post due to a need for the re-organization and rationalization of the enterprise\u2019s business, in accordance with the instruction of the Government of the Republic of Serbia. In the course of the procedure was determined that\u00a0the employees who were transferred to other posts, and whose place of work was changed and coefficient reduced, included people aged from 29 to 65. It was determined that PE \u201cSrbijagas\u201d Novi Sad provided sufficient evidence to conclude that the annex to the employment contract, by which M. N. was transferred to another post and another place of work, was not offered due to her age. The Commissioner for the Protection of Equality issued an opinion that PE \u201cSrbijagas\u201d Novi Sad did not violate the provisions of the Law on the Prohibition of Discrimination with Annex No. III to the employment contract No. 01-01-1\/475 dated 9 December 2014, by which M. N. was assigned to another post and another place of work.<\/em><\/p>\n\n\n\n\n
