OPINION

 

The opinion was issued in the procedure following a complaint filed by SSP on behalf and with the consent of 11 trade union members against the Ministry of Interior Affairs due to discrimination on the grounds of membership in a trade union organization. In the complaint was stated that the employees organized a strike in the Ministry of Interior Affairs in the period from 26 September to 5 October 2014 and that, during the strike and after it was finished, pressure was made on the employees by permanently transferring them to other posts and more remote places of work. In the declaration was stated that transfers were made in order to improve the work process and more functional performance of work, and not because of retaliation against strike participants. In the course of the procedure was determined that a total of 91 police officers were permanently transferred to the Police Directorate U. and the Police Directorate of the city of B, Police Brigade, Emergency Service, and Intervention Unit 92 in the period from 26 September to 31 December 2014, 67 of whom participated in the strike, that is, were permanently transferred to other posts and/or other places of work as well as the employees who did not participate in the strike. The Commissioner for the Protection of Equality issued an opinion that the Ministry of Interior Affairs did not violate the provisions of the Law on the Prohibition of Discrimination with the adoption of a decision on permanent transfer by which the complainants were transferred to other posts and/or places of work.
