Recommendation to the National Employment Service for the abolition of job advertisements containing discriminatory conditions for employment

Acting within the framework of legally prescribed competencies to monitor the implementation of laws concerning the prohibition of discrimination and to recommend measures to achieve equality to the public authorities and other persons (Art. 33, para. 1, items 7 and 9 of the Law on the Prohibition of Discrimination, “Official Gazette of RS”, No. 22/2009), the Commissioner for the Protection of Equality addresses to the National Employment Service the following

RECOMMENDATION

 

  1. In the future, the National Employment Service will not publish job advertisements containing discriminatory conditions of employment, such as those relating to gender, age, and appearance of a candidate, or any other personal property. An exception are situations where a job advertisement relates to a job with such nature, or when the work is carried out under such conditions, that a personal property constitutes a real and decisive condition for the performance of the job, if the intended purpose is justified, in accordance with Art. 16 para. 3 of the Law on the Prohibition of Discrimination and Art. 22 of the Labor Law.
  2. The National Employment Service will, without delay, take all necessary measures to prevent any possibility of publication of job advertisements which, contrary to the law, contain discriminatory conditions for employment, and will inform the Commissioner for the Protection of Equality no later than 30 days from the date of receipt of this recommendation.
